Why the Right Attorney Matters for This Agreement

Not all prenuptial agreements hold up equally in court. The drafting decisions made today can affect whether an agreement survives a challenge in the Family Division of the Eighth Judicial District Court years from now. Our founding partners, Matthew J. Winters and S. Alex Spelman, both graduated from the University of Nevada, Las Vegas’s William S. Boyd School of Law and bring complementary credentials that few family law practices can match.

Attorney Winters holds a Master of Laws (LL.M.) in taxation, a post-J.D. graduate degree that adds meaningful depth when an agreement involves business equity, retirement accounts, or assets whose division carries tax consequences. Attorney Spelman is an accomplished litigator with experience in both state and federal courts. Nevada’s Legal Framework for Prenuptial Agreements

Nevada is a community property state. Under NRS 123.220, assets and income acquired during a marriage are community property, and Nevada law generally divides that property equally in divorce unless a valid agreement says otherwise. A well-drafted prenuptial agreement can change that default by establishing clear rules for property ownership before any dispute arises.

Prenuptial agreements in Nevada are governed by NRS Chapter 123A, the Uniform Premarital Agreement Act. Under the Act, a prenuptial agreement can cover a defined range of financial matters:

What a prenuptial agreement can address:

Property rights and ownership for each spouse during and after the marriage
Acquisition, management, and disposition of property
Modification or waiver of spousal support and alimony
How property is distributed upon separation, divorce, or death
Coordination with wills, trusts, and other estate planning arrangements

Child support can’t be adversely affected by a prenuptial agreement under Nevada law. Custody is similarly determined by Nevada courts based on the best interests of the child at the time of any proceedings, and no prenuptial provision can bind that determination.

To take effect, the agreement must be in writing and signed by both parties. It becomes operative on the date of marriage. Under NRS 123A.080, a court may decline to enforce an agreement that was signed involuntarily, was unconscionable at the time of execution, or where one party wasn’t given fair and reasonable disclosure of the other’s property and financial obligations.

What Makes a Prenuptial Agreement Enforceable in Nevada

Drafting the document is only part of the work. How the agreement is prepared, disclosed, and signed can affect whether it holds up if it’s ever challenged. Several factors directly affect enforceability under Nevada law.

Voluntary Execution
Both parties must sign without duress or coercion. Courts scrutinize agreements signed in the days immediately before a wedding, when one party may feel they have no practical choice but to sign.

Full Financial Disclosure
Each party must provide fair and reasonable disclosure of their property, assets, and financial obligations. Omitting significant assets or debts is a recognized basis for a court to invalidate an agreement entirely.

Independent Legal Counsel
Nevada law doesn’t require both parties to have attorneys, but an agreement where only one side had legal representation is a recognized challenge ground. We recommend that the other party retain independent counsel before signing.

Timing
Nevada sets no specific minimum period before the wedding, but beginning the process well in advance of the marriage license application gives both parties time for review, negotiation, and disclosure without the time pressure courts find suspicious.

Starting early and proceeding carefully can reduce the risks that could later cause a court to set the agreement aside. We work with clients to build a process that addresses these requirements from the start.

Who Benefits Most from a Prenuptial Agreement

A prenuptial agreement is most valuable when there is a meaningful gap between what each party brings into the marriage, when one or both parties have obligations to children from prior relationships, or when business interests are involved. These are the situations where Nevada’s community property default creates the greatest exposure. Attorney Winters’s tax law background applies directly to agreements addressing business equity, retirement accounts, and assets whose value or division may carry tax consequences.

Business Owners
A prenuptial agreement can clarify that a business founded or grown before the marriage remains separate property and specify how any increase in its value during the marriage will be treated. Without that clarity, a business built over years may become subject to division in a divorce proceeding.

Individuals Entering Second Marriages
Those with children from a prior relationship often use prenuptial agreements to specify which assets are preserved for their children rather than subject to community property division. The agreement can also coordinate with existing wills and trusts to help support consistent treatment across both frameworks.

Those with Pre-Marital Real Estate or Investments
A prenuptial agreement can designate pre-marital real estate, investment accounts, retirement funds, and inheritance expectations as separate property so they don’t inadvertently become commingled community property over the course of a marriage.

Postnuptial agreements are also available for couples who didn’t execute a prenuptial agreement before the wedding or whose financial circumstances have changed significantly since they married.
