Why Attorney Review Matters Even When You Agree

Spouses who enter an uncontested divorce in good faith can still produce a settlement agreement with terms that create problems after the decree is final. Nevada is a community property state, meaning assets acquired during the marriage are generally divided equally, but misclassifying separate property or overlooking certain asset categories can create disputes once the court has closed the case.

Retirement accounts present one of the most common oversights. Dividing a 401(k) or pension correctly requires a Qualified Domestic Relations Order (QDRO), a separate court order directing the plan administrator to divide the account. Without one, the spouse entitled to a share of those funds may face tax penalties or lose access entirely. Attorney Winters’s LL.M. in taxation positions our firm to identify these issues before the agreement is filed, not after.

Once a joint petition decree is entered in Nevada, both spouses waive the right to appeal. That makes the drafting stage the most important stage.
